Prosecutors want a panel of three judges to give them permission to try three men for the murder of Surjit Singh Chhokar in 1998.
Crown Office lawyers asked for permission to prosecute the trio at a hearing before the judges at the High Court in Edinburgh on Monday.
The Crown allege that David Montgomery,37, Andrew Coulter,33, and Ronnie Coulter,46, murdered Mr Singh in Overtown, Lanarkshire, in 1998.
The hearing, which is being heard before Lord Carloway, Lady Dorrian and Lord Malcolm, continues.
It is scheduled to last four days.
